Our services are for adults aged 18 and over. This policy explains how we keep it that way, what we do if a child's information reaches us, and the laws it is built around.
1. Our Position
WA AI Hub, the AI Governance Hub™ and the Responsible AI Governance Sprint™ are professional services for people who work on AI governance, risk, privacy, procurement and policy. They are for adults. You must be 18 or older to create an account, subscribe, apply for the Sprint, attend a Sprint session or contact us as a customer.
We chose 18 because it is the age of majority in Western Australia and so the age at which a person can generally make a binding contract. It is also above the age of digital consent in every EU Member State, which ranges from 13 to 16. One clear rule is simpler and safer than different rules for different places.
We do not knowingly collect personal information from anyone under 18, we do not market to children, and none of our features are designed to attract them.
2. How We Handle Age
When you create an account or apply, we tell you that you must be 18 or older, and by continuing you confirm that you are. This is a self-declaration.
We do not ask for proof of age, a date of birth or identity documents. Collecting those would mean collecting more personal information than we need. For a low-risk professional service with no social features, we think a clear rule and a clear confirmation are the proportionate approach. We will revisit this if the risk changes or a law or regulator requires more.
We do not use personal information to estimate a person's age, and we do not profile visitors.
3. If We Learn a Child Has Used the Services
If we find out that a person under 18 has created an account, applied, or given us personal information, we will close the account or stop processing and delete the personal information as soon as we reasonably can, and no later than 30 days after we confirm it, unless the law requires us to keep it. We will refund any payment that was taken, because a minor generally cannot be bound by the contract.
Parents and guardians who think a child has given us information can ask us to delete it. Use the contact form or email privacy@wahub.ai, and tell us what you know. We will acknowledge your request within 5 business days. We may need to ask you for some details to find the right record, and we will not ask for more than we need.
We will not use anything we learn from a report for any other purpose.
4. Information About Other People's Children
Our members include people who work in schools, universities, child-related services and government. The Services do not need personal information about children to work.
Do not put identifiable information about children or students in applications, in the contact form, or in documents or sessions in the Sprint. Use de-identified or fictional examples. If you share information about a child that you were not entitled to share, tell us and we will delete it.
5. What We Do Not Do
We do not show advertising, and we do not sell or share personal information for advertising.
The Site and the Hub do not offer public posting, messaging between users or other social features.
We do not use automated decision-making or profiling about children.
We load analytics only after a visitor agrees. Our cookies and analytics are described in the Privacy Statement.
6. The Laws This Policy Is Written Around
| Law or standard | How it relates to us |
|---|---|
| Age of Majority Act 1972 (WA) and the general law on minors' contracts | A person under 18 generally cannot be held to a contract, so we do not contract with them. |
| Privacy Act 1988 (Cth) and the Australian Privacy Principles | We handle personal information as if the Act applied to us. The Act requires extra care with information about children. We avoid collecting it. |
| Children's Online Privacy Code (Privacy and Other Legislation Amendment Act 2024 (Cth)) | The OAIC is developing a code for online services that are likely to be accessed by children. We are not such a service. We will review the code when it is registered. |
| Online Safety Act 2021 (Cth) and the social media minimum age law | We are not a social media service and have no features for people to interact with each other. We cooperate with the eSafety Commissioner. |
| Working with Children (Criminal Record Checking) Act 2004 (WA) | We do not do child-related work as defined in that Act. If we ever do, we will meet its requirements before we start. |
| General Data Protection Regulation (EU) 2016/679, Article 8, and recital 38 | Where the GDPR applies, children's data deserves specific protection and, for services offered directly to children, parental consent is needed below the national age (13 to 16). Our services are not offered to children. |
| UN Convention on the Rights of the Child, General Comment No. 25 | We apply the principle of the best interests of the child by keeping children out of our data and our service, and by acting promptly on reports. |
7. Questions, Reports and Complaints
Contact us by the contact form or at privacy@wahub.ai. Our Privacy Statement explains how to complain to the Office of the Australian Information Commissioner, and to an EU data protection authority.
If you are concerned about harm to a child online, you can also report to the eSafety Commissioner at esafety.gov.au. If a child is in immediate danger, call 000.
8. Review
We review this policy at least once a year and when the law changes. It forms part of our Terms and Conditions.
